Seriously wtf is up Nintendo’s ass lately. They’ve always been litigious but the last few years have been pretty extreme.

The fact that DMCA requests don’t have to be signed with an asymmetric key that lets you validate the company that sent it was actually behind the request is some of the dumbest shit.

We’ve known how to use certs online forever. Certainly well before the DMCA. Why the fuck wasn’t that a provision?

Oh right because our politicians are tech illiterate apes.

The emulator is more likely that the Switch 2 was supposed to be released this year and ended up getting pushed to next year. This means they have to support the Switch fully for another year and it’s a harder sell when it’s easy for customers to make a choice between:

          • A Switch and 3ish games

          Or

          • A Steam Deck that can play all the Switch games for free

When these are both the same price. The fact that instructions were easy to find and follow didn’t help.

They’re like Japanese Disney. They’re nothing without their IP and they know it.

They also know that the only reason they have DK as a character is because Universal dropped the ball in protecting their IP. If they let Garry’s Mod casually have a “Mario” character in it, it dilutes their ability to legally go after some other studio who straight up makes an unofficial Mario game.

It started after Satoru Iwata’s death in 2015. He was a notorious true gamer/engineer before CEO and his vision was always long-term. The two who have replaced him since have decidedly chosen the short-term route for fast profit vs long term consumer binding.

How efficient is it to antagonize people that are actively promoting your own content for free on other platforms? Does this actually work for Nintendo?

I guess they antagonize anyone that has moderate exposure using their IP

In some countries copyright law says that if you let people use your copyrighted material with little to no impediment then you cannot suddenly request whoever is using your material to stop

Let’s say that Nintendo allows fans to make fan made Mario games for 5 years. Then they suddenly sue everyone and say “hey you have to pay for copyright or shutdown”. A judge can decide that since they didn’t enforce their copyright for some time they cannot sue people that are using their IP.

From a legal perspective the act of policing your own copyrighted material is the company’s responsibility. This law prevents companies from relaxing their copyright claims for years (essentially allowing people to use it) and then suing everyone for using their IP. In other words Just let everyone use it, then sue them. The law is there to prevent that

Nintendo is likely super strict because “let people use your copyrighted material with little to no impediment” has room for interpretation in a court room. So they go to the conservative side and shut down everyone. Also consider that they’re right next to China. The piracy capital of the world. It’s not a surprise they’re scared about their copyright.

I’m not saying that what they’re doing is right. It’s not. But I see where it comes from.

    Nintendont,
the lawsuit company that makes games on the side, strikes again…

We’re well beyond the point by now of me ever buying anything from them again.
I won’t support such behavior of any company.

I heard if you go into your bathroom and turn off the lights. Then close your eyes and spin around three times well saying “Nintendo, Nintendo, Nintendo!”

It will summon their lawyers and they will drag you to court through your bathroom mirror for violating copyright.

Saving this site. I was still using 1337x through a proxy.

Edit: Actually just clicked the link and noticed that I used it before I think for 2 trails games, maybe. I had already bought it on PlayStation and wanted to play it on PC as the whole trails series is on PC and not PlayStation and I owned most of the games at the time on PC so wanted the last of the 2 cold steel games to finish the collection and that way they were in one place.

I might get a switch 2 only after it’s hackable. I thought of doing it with the switch but it seemed too complex for me. At this point I’m really fed up with Nintendo’s anti consumer bs. And I’m not just referring to the copyright takedowns and closure yuzu but things like the Mario all stars collection which they then created artificial scarcity around and the Zelda anniversary where they release a HD remaster of skyward sword which is seen as the weakest of the series. I do enjoy the odd Nintendo game but I’ve had my switch since the year after it came out and I’ve only beaten 4-5 games on it and I’ve only 10-20 at most on it and those are mostly indies.

        Another year or two…

Problem is that Nintendo for all their faults still make GREAT games for kids. And if adult pc gamers think they have it bad they should have a look at the predatory shitshow that is tablet games for the 5 and under market… its properly fucking ridiculous. At least Nintendo has the common decency to give me an amazing and full game for its eyewatering prices.

the indie space still has a ton of stuff. you lose the benefit of always having accessibility features and easy ui navigation depending on the game (although a ton of indie games have better modding and accessibility support than a lot of high budget games as of recently, just in case they come to be interested), but you still get to see a ton of different stuff.

          • Celeste
          • OneShot
          • Rythm Doctor
          • Terraria (has android ver.)
          • A Dance Of Fire And Ice (has android ver.)
          • MiniMetro (has android ver.)
          • ShatteredPixelDungeon (has android ver.)
          • StuntRally
          • Mindustry (has android ver.)
          • HyperRogue (has android ver.)
          • SuperMeatBoy
          • Don’t Starve
          • Undertale/Deltarune (have unofficial android ver.)
          • Sky Rogue
          • SuperTuxKart (has android ver.)

most of these without coming close to Nintendo’s approach to fan works, so i’d say you’re not going to lose much if you know the right places.

if you want games for Android, Mitch is a third-party access to itch.io, a game store where you can by the game and get the game straight into a zip file or what-have-you. no DRM, no questions asked. about half the games i mentioned are in there without the predatory behavior most of the time.

i’d probably pick MiniMetro and simple rythm games like ADOFAI or Rythm Doctor to begin with, simple shapes and an obvious thing to learn to do.

MineTest (has android ver.) and StuntRally are pretty close to reach if you’re willing to be patient and teach them to explore an open space on their own or of their own (one is basically a sandbox engine like Garry’s Mod, the other has a map editor alongside the several open maps). takes a while to understand the UI of each but it’s possible to use.

Celeste is notoriously difficult regardless of age, as a platformer about climbing a mountain, but i’m sure they can grasp it (no pun intended).

non-game programs are also an option. i remember having my mom teach me to use MSPowerPoint which made me break and build a ton of things later on by the time i was 7, it was a mess, but i made that mess :3
try an art program like Pencil2D, Krita or InkScape, maybe something unrelated like LibreOffice Impress or KDE Marble, or a music program like MilkyTracker (has android ver.) and take your time to teach them to make a tune or a flipbook or navigate a map, i’m sure they’ll have fun with something like it too.

You press the server list and the first thing you see is just a massive list of Nazi Germany RP going by as many names as you can think of. You keep scrolling down looking for a normal sever and learn every possible way to code “you play as the Nazis in this server” as you go.
